Transient Accommodation Rentals Draft Legislation Impacting Hosted Rentals

Members of the County of Hawaii Council have been reviewing the Short-Term Vacation Rental regulations and are currently working on draft legislation to amend the law. Some issues that have been proposed in the most recent draft include changing the name of Short-Term Vacation Rental to Transient Accommodation Rentals (using the acronym of “TAR”), changing the definition of a “short-term” rental stay from “30 consecutive days or less” to “less than 180 days,” tightening enforcement of permit expiration dates, and regulating hosted rentals. The proposals are still part of a working draft and no date has been set for the draft to be introduced as legislation for the County Council to consider. Hawaii County has adopted Ordinance 2018-114 which places the burden of complex regulations on property owners that wish to earn TAR income.
